Liability wAiver
Assumption of Risk
By signing up for and/or attending LUX LABS classes, activities, events, workshops and other programs and for using LUX LABS’ premises, facilities, and equipment (collectively, Classes and Facilities), you hereby agree that there are certain inherent risks and dangers with Xformers and exercise and on the Xformer as well as exercise equipment in association with the Classes and Facilities. These inherent risks and their consequences include but are not limited to minor injury, major injury or paralysis and death.
I hereby affirm that:
(1) I am aware of the risks associated with the Classes and Facilities;
(2) I understand and appreciate the risks and their consequences; and
(3) I assume responsibility for the risks and their consequences.
Waiver of Negligence
In consideration of being allowed to participate in and access the Classes and Facilities provided by LUX LABS, in addition to the payment of any fee or charge
I affirm that:
(1) I assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Classes and Facilities;
(2) I waive, release and forever discharge LUX LABS, its management, officers, agents, members, employees, representatives, volunteers, sponsors, insurance carriers, equipment suppliers and all others from any and all responsibility, claims, rights, causes of action and/or liability from injuries or damages to my person or property resulting from my participation in and use of the Classes and Facilities, including but not limited to ordinary negligence of the provider; and
(3) I make this waiver on behalf of myself, and on behalf of my spouse, personal representatives, next of kin, heirs, executors, administrators and assigns.
Medical Conditions
LUX LABS hereby advises you that individuals with any chronic disabilities or conditions are at risk in using LUX LABS’ Classes and Facilities, and are advised against doing so. In addition, if in the opinion of LUX LABS’ staff, you would be at physical risk using LUX LABS’ Classes and Facilities, you will be denied access to LUX LABS and its Classes and Facilities until you furnish LUX LABS with an opinion letter from your medical doctor, at your sole cost and expense, specifically addressing LUX /// LAB's concerns, and stating that LUX LABS concerns are unfounded. If you decline to obtain such a letter, you will not be permitted to use the Classes and Facilities of LUX LABS.
I affirm that:
(1) I have no health problems that preclude participation in the Classes and Facilities;
(2) I have not been instructed by a physician not to participate in the Classes and Facilities or similar activities;
(3) I authorize emergency medical care if needed, including but not limited to first aid, CPR and AEDs, emergency transport and sharing of medical information with medical personnel;
(4) I assume all costs involved in the provision of any emergency medical care provided pursuant to (2) above; and
(5) I agree to follow all safety rules and instructions of management and staff and inform management or staff of conduct or condition that might endanger myself or others.
Covid-19
I agree that I will not participate in any LUX LABS programs if I am sick, not feeling well, have an elevated temperature, or have been exposed to any contagion, including the Coronavirus. I agree that I alone am responsible for my health and safety while I am on the LUX LABS premises or participating in the LUX LABS programs and will take all necessary precautions to protect myself as recommended by the Centers for Disease Control.
I affirm that:
(1) I do not have any symptoms related to and have not been knowingly exposed to Covid-19.
(2) I agree to keep my hands washed/sanitized while at the studio.
(3) I will practice social distancing while in the studio and maintain as much space as possible between myself and other clients.
Indemnification
By acknowledging below, you agree to indemnify, reimburse and hold harmless LUX LABS, its management, officers, agents, members, employees, representatives, volunteers, sponsors, insurance carriers, equipment suppliers and all others against all claims and costs associated with claims (including, but not limited to legal costs, attorney fees, court costs and investigative costs), both (1) made by yourself and your spouse, heirs, administrators and assigns arising out of an injury to the you, and (2) made by co-participants, rescuers and others arising from your conduct during participation in the Classes and Facilities.
Duration and Integration
The agreement supersedes any and all prior oral or written promises or agreements and shall remain in full force and effect during this an all subsequent participation in the Classes and Facilities.
Severability
In case any provision in this agreement shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall, to the fullest extent permitted by applicable law, not be in any way affected or impaired thereby and shall remain in full force and effect.
Governing Law
THIS AGREEMENT AND ANY DISPUTE ARISING OUT OF PARTICIPATION IN THE CLASSES AND FACILITIES SHALL BE GOVERNED BY THE LAWS OF THE STATE OF ALABAMA.
Waiver of Jury Trial
THE UNDERSIGNED HEREBY IRREVOCABLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR PARTICIPATION IN THE CLASSES AND FACILITIES.
I acknowledge that I have read and understood this Assumption of Risk, Waiver, and Release, and have received the opportunity to discuss this with my legal counsel. I understand that I am relinquishing substantial legal rights, including the right of financial recovery for injury, whether the injury results from the inherent risks of the Classes and Facilities or from the ordinary negligence of LUX LABS. I am voluntarily participating in the Classes and Facilities and voluntarily signing this agreement releasing LUX LABS from liability for injury or loss.
Please read these Terms of Service (“Agreement”, “Terms of Service”) carefully before using www.luxlabstudios.com (“the Site”) operated by Lux Lab (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.luxlabstudios.com.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement. These Terms of Service set forth the legally binding terms for your use of Lux Labs Services. You are only authorized to use the Lux Labs Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to these Terms of Service. Please read these Terms of Service carefully and save it. If you do not agree with it, you should leave Lux Labs’ website and discontinue use of Lux Labs’ Services immediately. If you wish to become a Member, you must read these Terms of Service and indicate your acceptance during the registration process.
TERMS AND CONDITIONS
CANCELLATION POLICY:
WHAT IS THE CANCELLATION POLICY?
We have a 12 hour cancellation policy. You may cancel any class reservation at least 12 hours prior to class start time with no penalty and the class credit will be available for you to rebook.
A class that is cancelled less than 12 hours prior to the start time is considered a LATE CANCEL and will be forfeited if booked using a class credit. If the class is booked with an Unlimited membership a $25 fee will be assessed.
A class that is booked but not attended is considered a NO SHOW and will be forfeited is booked using a class credit. If class is booked with an Unlimited membership a $28 fee will be assessed
CAN I SWITCH CLASSES?
If the start of the class is before 12 hours you may cancel the class you are booked in and enroll in the new class time - Same day or last minute class swaps are still subject to the 12 hour cancellation policy even if there is an open spot in desired class time.
HOW CAN I CANCEL A CLASS?
Go to the lux labs app. Click on the reservation you would like to cancel and select “cancel reservation”. If you have issues canceling a class please email hello@luxlabstudios.com
LATE ARRIVAL POLICY:
NEW CLIENTS:
Please arrive 10-15 minutes before class time. We require all new clients to receive an introduction to the machine before class. Not only for your safety but for the safety of the other clients and coach. If you arrive at class time you will not be allowed to take class. You will be removed from the class so you are able to rebook another day or time.
EXISTING CLIENTS:
We have a 5 minute grace period. If you arrive 5 minutes past the start of class time (according to the studio clock) your spot will be given to a standby or waitlist client.
WAITLISTS:
HOW DOES IT WORK?
Waitlist spots are available for each class. You must have a class credit or a membership to join the waitlist. If the class time you want to take is full, add yourself to the waitlist. Click on the desired class time, then “Join the Waitlist”.
The waitlist is active until 12 hours prior to class. When a spot becomes available you will automatically be added to the class.A notification email and or text (make sure you opted in for class alerts) will be sent to you. Once added to the class the reservation is confirmed and is subject to the 12 hour cancellation window.
INSTRUCTOR CHANGES:
When you schedule your lux labs class you are paying for our workout, not the instructor of that class. The workout is the same throughout the day. Instructors are subject to change without notice.
ADDITIONAL TERMS:
All sales of classes and memberships are final. No Refunds.
Recurring memberships can be cancelled anytime with a 30 day written notice - please email hello@luxlabstudios.com to request.
Exchanges or store credit may be made on tagged unworn retail within 14 days of purchase. All sale items are a final sale.
All classes must be paid for in advance.
lux labs is not responsible for any lost or stolen items.
lux labs reserves the right to refuse business to anyone.
Grip socks are required in all classes - you can bring your own or purchase in studio!
